James McSweeney Solicitors had the privilege of representing the family of the late Nicola Phillips and to have brought their case to a successful conclusion. Her case was ruled by Mr Justice Cross in the High Court yesterday and we attach links to the various media reports which provide further detail. It was particularly gratifying to have the work of this office singled out for praise by the Court.
Having secured an admission of liability (albeit two years after the first notification of the case to the HSE and significant litigation) it was very important that the Apology was read out in open Court with members of Nicola’s family present.
The death of a loved one is always hard to come to terms with. The unnecessary death of a loved one is impossible to come to terms with. Damages never compensate and often a full apology is not forthcoming. We cannot emphasise enough the importance of an apology and taking responsibility for mistakes made.
We hope that Nicola’s husband David and her children together with Nicola’s parents and sisters and brother can take some comfort from the recognition that they have secured. May Nicola rest in peace.
