  • Workplace Accident Claim*

    Accidents happen in various types of situations, for example, in the workplace due to employers not implementing adequate safety measures, a lack of safety equipment, dangerous machinery or premises, and a lack of proper training or supervision.

  • Back Injury*

    The main cause of back injuries can be attributed to two actions:

    • Lifting heavy items
    • Incorrectly lifting an item

    These injuries can be very common among manual workers.  Employers can be negligent if, for example, they haven’t provided their employees with sufficient training in the correct procedure for the picking up of heavy objects.

  • Head Injury*

    A head injury can be described as anything from concussion, skull fractures to a catastrophic brain injury.  The long term implications of such injuries can be difficult to determine and can require some considerable investigation.

  • Sports and Recreational Injuries*

    The injuries that can occur from sports and recreational accidents can range from the simple cuts and bruises to the more complex broken bones and concussions.  There are two types of sports injury: traumatic impact and overuse.  Traumatic injury could be described as a blow to the head and an overuse injury is the result of the repeated use of a body part. If the equipment you were supplied by the sport organiser was not fit for purpose then this could lead to you being injured and therefore potentially being able to take a case.

  • Slip and Fall Claims*

    Slip and falls can happen to any one of us at any time whether it be a spillage in a supermarket or an uneven pavement.  Depending on the circumstances of the incident it could be due to the negligence of another party who had a duty of care towards the person involved. You may not have realised it at the time of the accident/incident but there may now be more injuries as a result that you hadn’t factored in when you fell. You may have had to take off work to recuperate, incurred expensive medical bills or developed psychological issues as a result. This is why there is a period of two years after the date of the incident to make a claim.

  • Children (minor) Claim*

    Where a minor claim differs from an adult claim would mostly lie within the time limits given to issue proceedings.  Normally, in adult cases, the injured party has a maximum of two years after the date of the accident with which to issue court proceedings, minor cases are afforded until the child in question has reached eighteen and then they have the standard two years awarded to them.


  • Defective Product

    When making a defective product claim you need to be able to prove that the product in question is defective and that it is because of that defect that you were injured. For example, if you buy a radio that isn’t earthed properly but you use the radio in the bathroom where it is wet and therefore extremely dangerous, there is little chance of a successful claim as you have contributed to your own injury.  If you use the hairdryer in the bedroom where it’s dry and you suffer an injury, you may have a claim.   • How to make a Claim*

    Contact us at James McSweeney Solicitors and we will advise you if you have a claim and whether to proceed.  If we deccide you do have a case then the following occurs:

    • Initially, your claim will be sent to the Personal Injuries Assessment Board.
    • The Personal Injuries Assessment Board will appraise the claim and will revert back to us within 90 days with an assessment.
    • You can then decide, with our advice, whether you wish to accept the assessment or reject it. If you reject it you will move on to the next stage of the process.
    • Legal Proceedings will be issued.
    • Before the Hearing takes place, it is likely that settlement talks could take place and your case could be resolved without you ever having to go to Court.
    • If your case isn’t settled at the talks stage, then it will have to go to trial and a Judge will rule on the issue.

  • James McSweeney has a special interest in Medical and Clinical Negligence* claims. Prior to setting up his own practice in 2007, James managed one of  Ireland’s leading specialist Medical Negligence* and Personal Injury* firms. He has experience in all Courts from the District Court to the Supreme Court, including the Supreme Court case of Roche –v- Roche.  This is, arguably, the most important legal case in the history of the Irish State.  In his Judgement, the Chief Justice noted that the issues raised were… “profound and complex on novel aspects of birth, the right to life and reproductive rights”.  This is the case that finally decided the status of the unborn in Irish Law.

  • Emma Meagher, from Boherlahan, Co Tipperary, has been appointed as Partner heading up the Women’s Medical Negligence Unit at James McSweeney Solicitors. Emma joined James McSweeney Solicitors in 2008.  She quickly established herself as an invaluable member of the Team and is now recognised as one of Ireland’s leading Medical Negligence Solicitors.

    Throughout her early years in the legal business, Emma developed and refined her keen interest in helping women who have suffered as a result of negligence during pregnancy, childbirth, and the postpartum period.  As a result, in 2015, Emma established a unique, mother-focused, legal advice unit and has built a support team with a wealth of interest and experience specialising in obstetrics and the Law.

    Emma brings a professional and empathic approach to her work. She has regularly featured in various national publications and is consulted widely by media contributors on Medical Negligence Law.

    A mother of two young boys, away from work Emma can be found most Saturday mornings watching football training at Wicklow Rovers and likes to spend afternoons with her family exploring the Wicklow countryside and beaches. She balances her busy work life with a love of cooking, literature, art and horse racing, especially flat racing.

    Happy to give something back to the Community she finds the time to volunteer with the Free Legal Aid Board and also offers free legal advice to the London Irish Centre, Camden.

  • Adrina is a member of the Irish Institute of Legal Executives and has been a part of the James McSweeney Solicitors team for 10 years.  Adrina works exclusively in the areas of Medical Negligence* and Personal Injury* litigation.

    Adrina’s level of commitment to her clients and colleagues has earned her a reputation for hard work and attention to detail.  Adrina liaises closely with clients and experts during the Injuries Board process, preparing cases for trial and also attending settlement discussions at the Four Courts. Adrina has had tremendous success in dealing with Infant Rulings before both the Circuit and High Courts.

    Outside of working hours, Adrina is a keen equestrian and regularly partakes in competitions.

  • Fiona has been with James McSweeney Solicitors from the start (2007) and is an integral part of the practice. Fiona works closely with the Principal, James,  working in the area of Medical Negligence* and Litigation*. Fiona also works closely with experts, preparing cases for trial.
