James McSweeney Solicitors has successfully secured a settlement of more than €500,000 on behalf of a client who suffered Erb’s palsy following a brachial plexus injury caused by negligent care during childbirth.
The case arose from the circumstances surrounding the client’s birth, during which it was alleged that excessive and inappropriate force was used in the delivery process. As a result, the client sustained a brachial plexus injury, causing Erb’s palsy—a serious condition affecting the nerves that control movement and sensation in the shoulder, arm and hand.
What is Erb’s Palsy?
Erb’s palsy is a form of paralysis or weakness affecting the upper arm that occurs when the brachial plexus nerves are damaged. While some infants recover fully, others are left with permanent disability, reduced strength, restricted movement and ongoing pain. In more severe cases, surgery, extensive physiotherapy and lifelong medical care may be required.
Although some brachial plexus injuries can occur without negligence, they may be preventable where recognised obstetric risks are appropriately managed and accepted standards of care are followed during labour and delivery.

In this case, it was alleged that the injury resulted from the negligent use of excessive force during delivery. Following a detailed legal investigation, supported by expert medical evidence, the claim was successfully resolved with a settlement of over €500,000.
