Trip and fall in Hotel – Occupiers Liability

Trip and fall in Hotel – Occupiers Liability

General Practice Case Studies

Our client, in this case, was a lady who while vacationing in Ireland with her husband tripped and fell on a loose carpet in a popular hotel based in Connaught.

Unfortunately, this lady fractured her hip in the fall resulting in her having to have emergency surgery and bringing her holiday to an end. Our client spent months recovering and thankfully, had an excellent result. There was a small risk of her requiring surgery in the future and this had to be valued and included in the claim.

The Defendants admitted liability early on in the proceedings as the hotel was aware of the defect in the carpet. This case was one for assessment of damages only.

A trial date was obtained. The Solicitors for the Defendants requested a settlement meeting the week before the case was due to be heard. The offer put forward was unfortunately minimal and rejected by our client. On the morning of the trial, the case settled for almost double the amount offered at the settlement meeting.

Our client was delighted with the result and thankfully she had the confidence in her legal team to reject the offer put forward at the settlement meeting and proceed to trial.
